1. Agreement to these terms

Vialmetry is published by Crestwood Holdings Management LLC (“we”, “us”). These Terms of Use are an agreement between you and us. By downloading, installing or using Vialmetry, or by creating an account, you agree to them. If you do not agree, do not use Vialmetry.

Our Privacy Policy explains how we handle personal data and forms part of these terms.

2. Not medical advice or a medical device

Vialmetry is for personal record-keeping and educational purposes only. It is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. It does not provide medical advice, diagnosis or treatment.

• Vialmetry does not recommend medications, compounds, doses or schedules, and it does not decide whether any dose is appropriate for you.
• Its calculations only convert the numbers you enter (for example, a vial’s strength and the water added into a syringe mark). The result is only as accurate as what you enter. Check every result yourself before relying on it; the working is shown on screen and explained on the How the math works page.
• Estimated levels and reminders are aids, not instructions. A reminder may not arrive if your phone’s settings, battery or notifications prevent it.
• A substance’s name appearing in the app is not an endorsement and does not mean it is approved for human use.
• Always consult a licensed healthcare provider about your health and any substance you use. Do not use Vialmetry in an emergency: call your local emergency number.

3. Who may use Vialmetry

You must be at least 18 years old and able to form a binding agreement. You may use Vialmetry only where doing so is lawful for you.

4. Your responsibilities

• You are responsible for what you record in Vialmetry, for the decisions you make, and for complying with the laws that apply to the substances you obtain, keep or use. Vialmetry does not sell, source or supply any substance.
• Do not use Vialmetry, or the account service, to break the law, to harm or impersonate anyone, or to store content that is not yours to store.
• Do not interfere with or overload the account service, try to access another person’s account or data, or bypass its security.
• Do not copy, modify, redistribute or resell the app, or reverse engineer it, except where the law allows this despite these terms.

5. The optional account

You can use every part of Vialmetry without an account. If you create one to keep a private cloud copy of your log:

• Use an email address you control, and keep your password private. You are responsible for activity on your account.
• Tell us promptly at info@vialmetry.app if you think someone else has used it.
• You can delete the account at any time in the app (Settings → Private cloud sync → Delete cloud account), or by following the steps on the account deletion page.

6. Your data

What you record in Vialmetry belongs to you. It is stored on your device. If you choose Save to cloud, you allow us and our service providers to store and transmit your cloud copy only so we can keep it for you and return it to your devices; we do not use it for anything else. The Privacy Policy describes this in full.

You are responsible for keeping your own backups. The app can export your history as a spreadsheet or a complete backup file at any time. We keep no backup of cloud copies, so a deleted cloud copy cannot be recovered.

7. Updates and availability

We may update Vialmetry from time to time, including by delivering improvements when the app opens. We may change, suspend or discontinue features, including the optional account and cloud copy. If we plan to discontinue the cloud copy, we will give reasonable notice where we can so that you can export your data. The app’s on-device features do not depend on our service.

8. Price

Vialmetry is free. It has no ads, in-app purchases or subscriptions. If that ever changes, we will tell you before you are asked to pay anything.

9. App stores

If you got Vialmetry from the Apple App Store, Apple’s Standard Licensed Application End User License Agreement applies, and these terms add to it; where the two conflict about the app licence, Apple’s agreement prevails. If you got Vialmetry from Google Play, the Google Play Terms of Service also apply.

These terms are between you and us, not Apple or Google. Apple and Google are not responsible for Vialmetry, its content, maintenance or support, or any claim relating to it, including product liability, legal compliance or intellectual-property claims; we are, to the extent these terms do not exclude it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you as they relate to the App Store version of the app.

10. Ownership

The Vialmetry app, name, logo, website and their contents (apart from your data) belong to us or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes under these terms.

11. Disclaimers

To the fullest extent the law allows, Vialmetry and the account service are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability and non-infringement. We do not promise that Vialmetry will be uninterrupted, error-free or secure, or that any calculation, estimate or reminder will be correct or delivered.

12. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcome, profits or goodwill, arising from your use of, or inability to use, Vialmetry. Our total liability for any claim relating to Vialmetry is limited to US$50.

Some places do not allow these exclusions or limits. Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer that cannot be waived.

13. Ending your use

You can stop using Vialmetry at any time by deleting the app and, if you have one, your account. We may suspend or close an account that breaks these terms or puts the service or other people at risk. Sections 6 and 10 to 14 continue to apply after your use ends.

14. Governing law

These terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Oklahoma County, Oklahoma, unless the law where you live gives you the right to bring it in your local courts.

15. Changes to these terms

We may update these terms. We will post the new version on this page with a new effective date and, for significant changes, tell you in the app or by email if you have an account. Continuing to use Vialmetry after a change takes effect means you accept the updated terms.
